1. General - Scope
The product is distributed by Adrian Summermatter, hereinafter referred to as "ribisu.ch".
Product sales are subject to these general terms and conditions, which apply to all offers, orders and deliveries. ribisu.ch provides all deliveries and services related to the sale of products on the basis of these general terms and conditions. General terms and conditions that deviate from or supplement these terms and conditions are not recognized unless we have confirmed them in writing.
With your written order to [email protected] you accept these general terms and conditions.
Deliveries of goods are mainly made in Switzerland. The delivery of goods to other countries is fundamentally possible. Since the sales tax varies in many countries, an individual offer must be requested from the customer at ribisu.ch. ribisu.ch expressly reserves the right to change these general terms and conditions at any time and to apply them to all contracts concluded after the change. We therefore ask you to observe our conditions regularly.

The content of this homepage is protected by copyright, unless otherwise stated. The content may not be published, changed, or used for public or commercial purposes without written permission. ribisu.ch cannot guarantee or accept liability for the correctness or completeness of its homepage and excludes any liability for incomplete or incorrect content.
3. Order
a) Conclusion of contract
A contract between ribisu.ch and the customer does not come about with the order, but only with the acceptance of the order by ribisu.ch, at the latest when the goods are delivered. An order confirmation will be sent to the customer at the email address provided.
ribisu.ch is not obliged to accept an order. If we cannot fulfill an order, we will inform the customer of this.
b) prices
All prices are in Swiss Francs, including VAT. The prices in the online shop are always non-binding prices. Changes are possible at any time. The decisive factor for the invoice amount is the price of the goods at the time the order is received by ribisu.ch, which can be seen on the order confirmation (by email).
4. Guarantee / warranty
The guarantee period is 24 months from the day on which the goods leave our house, if a longer or shorter guarantee period is not expressly stated on the delivered goods. This guarantee only includes ribisu.ch's own bicycle frames and products. All other parts and components are excluded from this guarantee. The guarantee on attachments is regulated by the guarantee provisions of the respective manufacturer.
Defects that can be seen in the delivery of the items must be immediately objected to within 10 days, otherwise the goods are considered approved. The customer will inform ribisu.ch immediately in writing about hidden defects that will only come to light at a later point in time. At our discretion and with your consent, we will rectify the defects free of charge or provide you with an equivalent replacement. If we are unable to remedy the defects or provide a replacement within a useful period, you have the right to withdraw from the purchase contract or to reduce the purchase price. Please have the goods ready at our disposal.
Damage caused by natural wear and tear, improper consumption and inadequate or incorrect maintenance are excluded from the guarantee.
Please keep the supporting documents (invoice) required to prove the guarantee / guarantee start date carefully.
In warranty cases, the products must be submitted directly to ribisu.ch. Any costs for returns are borne by the customer. Damaged goods must be reported within 10 days of the damage with photos. This in writing to Ribisu.ch or by e-mail to [email protected]. Otherwise, the guarantee will expire.
The guarantee extends to all defects occurring within the agreed guarantee period, provided that these can be proven to be caused by poor material or faulty manufacture. However, the liability is limited at the discretion of the guarantor to repair, replacement or reimbursement of the invoice amount for the defective goods. Further claims of the buyer are excluded. In particular, Ribisu.ch is not liable for damage that can be attributed to improper use or natural wear and tear, or for damage that did not occur to the delivery item itself (consequential damage). If a bicycle frame or bicycle frame parts are replaced, we will replace them in the same color depending on availability, but reserve the right to replace them in a different color or with a successor product if they are not available.
The warranty claim expires in the event of improper use, natural wear and tear or improper use in accordance with the areas of application for the respective product shown on our website.
The guarantee does not apply to damage caused by improper handling such as:
Inadequate care and maintenance (neglect of the product)
Changes to the individual components (e.g. engravings, holes or paintwork).
Adding and converting additional components not expressly approved by us or replacing the components installed by us with non-identical components.
Continuous operation of a bike with incorrectly adjusted, defective or knocked out bearings or defective spring elements.
Damage to the seat tube in the area where it protrudes from the top tube as a result of a seat post that is pulled too far out of the seat tube,
Fall, overload, jumps or overstress of any other kind.
This means that the guarantee does not apply if the bicycle shows any damage or wear and tear caused by overuse of any kind, in particular falls and jumps. In any case, there are overstresses:
A deformation of the frame. This is the result of an overload and therefore a sign of improper use of a bent or broken derailleur hanger (attachment point of the rear derailleur). This is a result of overload or incorrect adjustment. This component represents a predetermined breaking point and protects the frame and rear derailleur from damage due to overload. Changes to the product that are made without our written consent or were made by Ribisu.ch, as well as non-compliance with the general terms and conditions, invalidate the guarantee.
It is hereby expressly pointed out that no liability claims can be made against Ribisu.ch for indirect damage or consequential damage to the customer, unless there is damage caused by Ribisu.ch through gross negligence. In particular, damage from accidents, etc. that arise from the handling of our products is your own responsibility.
The ribisu test fleet and service partners, as well as specialist retail partners chosen for deliveries, are independent companies that provide specific services for customers of Ribisu.ch and on their behalf. Ribisu.ch assumes no direct liability for these services, nor for other services that are provided in a direct order between the partners and the customer or for negligent or inadequate handling and implementation of the agreed services.
Please note that data communication via the Internet is not guaranteed to be error-free and / or available at all times according to the current state of the art. In this respect, we are not liable for the constant, uninterrupted and error-free availability of our online shop.
We did our best to reproduce the colors of our products as true to the original as possible in the online shop. The quality of the images also depends on your screen. Therefore we cannot guarantee that all colors can be reproduced really perfectly and true to the original.
5. Terms of delivery and payment
a) Delivery and payment
Shipping is at our risk. ribisu.ch assumes no liability for non-delivery or late delivery of products due to incorrectly declared delivery addresses, absence of the recipient or events that can be attributed to force majeure.
All prices are in Swiss Francs including VAT. Price changes remain reserved. We reserve the right to invoice the prices valid on the day of delivery. The shipping cost is CHF 20.00. For deliveries to other countries, the shipping costs will be determined and offered by written notice. An additional CHF 15.00 will be charged for cash on delivery. Basically we send all articles by post priority (A-Post), therefore the delivery time is 1-2 days depending on the order time. Large "bulky goods" packages (2 measurements over 60cm or 1 measurement over 100cm) are sent by DPD or DHL courier. Your order can be picked up from us in Ausserberg VS by prior arrangement, postage already charged will be credited to your customer account or deducted directly when paying in cash.
b) Vat when shipping worldwide
When shipping outside of Switzerland, the ribisu.ch invoice does not include sales tax. You pay the sales tax (VAT) applicable in your country directly to our shipping partner.

d) Retention of title
The goods remain the property of ribisu.ch until the invoice amount has been finally paid. If the goods are not available at the time of ordering, we would be happy to order / manufacture new ones.
e) Delivery times
The delivery by us takes place under the reservation that we ourselves are delivered correctly and on time. Compensation for delayed performance is excluded unless there is intent or gross negligence.
The ordered items, if they are in stock, are usually delivered within approx. 2-3 working days from the order. Items that are currently not in stock will be made ready for dispatch immediately upon receipt.
6. Right of withdrawal
All items ordered from our online shop for private purposes can be returned or exchanged within 10 days of receipt of the items.
Timely dispatch of the goods is sufficient to meet the deadline.

You will bear the cost of the return.
When returning the goods, please state your original order number and - for our information - the reason for the return request. Also write down whether you want a replacement or a credit. ribisu.ch is available for questions. Unfortunately, the costs of the original shipment of the goods to the customer cannot be reimbursed. In the event of a decrease in the value of the goods, we reserve the right to demand compensation, unless the reduction in value is based solely on the examination of the goods as would have been done in the shop.
The articles will only be reimbursed when we have received the returns.
In the event of cancellation of the order, we reserve the right to assert claims for damages for packaging and goods that were damaged outside of the return.
7. Use of data, data protection, security and data updates
a) We respect the privacy of our customers and will treat your personal data confidentially and in good faith. By placing an order with ribisu.ch you give your consent that your data may be used within ribisu.ch as follows:
On the occasion of the first contact, the data is collected in the form of personal information such as last name, first name, address, email for business transactions and for marketing purposes.
Personal data of the customers will not be passed on to third parties - with the exception of corresponding legal obligations and the transfer of the data required for order processing. It is ensured that the data will not be used by third parties beyond the specific customer order without the customer's consent.
b) Your payments by credit card, postcard and Paypal are transmitted using SSL encryption.
c) You can update your data quickly and easily: Log in via "Your account" and select "Edit account data". Update the necessary information there and then click on "Save".
8. Applicable law and jurisdiction
In the event of a dispute, only Swiss law is applicable.
Place of performance and jurisdiction is the district court Visp, 3930 Visp.
